Affirmed order revoking parole. Defendant after having served his sentence for first degree murder, second degree robbery and kidnapping was released on parole. He violated the terms of his parole by violating curfew. The trial court revoked his parole, but cited concerns about the harshness of the punishment given the infraction. The appeals court stated that the meaning of Penal Code sec. 1885 is clear and the court is not at liberty to alter it and parole must be revoked.
