Vacated order denying peremptory challenge. Plaintiff sought writ of mandate commanding the trial court honor a peremptory challenge they filed against trial court judge. Trial court refused to honor challenge as untimely. Appellate court held that when a criminal case is dismissed and refiled it is a new case for purposes of a peremptory challenge.
