California Court of Appeal

In re J.M., 077508

Reversed and remanded. Defendant, a minor, was adjudged a ward of the court and placed on probation for making a false report of a bomb in his school. Appeals court held that Defendant’s words about the bomb were not protected by the First Amendment, but that he had not be properly notified of his right to seek a deferred entry of judgment and therefore reversed and remanded for further proceedings.
