Switzer v. Wood, 077206

Plaintiff prevailed at trial on causes of action for fraud, conversion of property and violation of Penal Code 496. PC 496 provides enhanced civil penalties for knowingly selling stolen property. These penalties include treble damages and an award of attorney fees. The trial court declined to award treble damages on a civil suit and a portion of the attorney fees. Appellate court reversed the trial court judgment as to PC 496 and attorney fees stating that the statute was clear and unambiguous.
