California Court of Appeal

People v Ramierez, 056522

Appellate court remanded case to juvenile court for a transfer hearing. Defendants were convicted in adult court of gang-related murders and sentenced to long prison terms while they were juveniles. Before final sentencing was determined, California passed Proposition 57 which prohibited juveniles being directly tried in adult courts. The appellate court ruled that in cases affected by Proposition 57, judgment should be reversed and remanded to juvenile court to hold a transfer hearing. If the juvenile court determined that the case would have been transferred to adult court, then the judgment stands. If not, then the case would be determined under juvenile standards.
