People v. Salinas-Jacobo, 152729

Held that the trial judge should not have discharged a juror for failure to perform the requisite duties, such as following jury instructions. Judges "must tread very carefully" in these situations because a defendant's right to due process is at stake. Because the erroneous dismissal of the juror was prejudicial, the judgment in this vehicular homicide case had to be reversed.
