Affirmed a conviction of assault with a deadly weapon. Held that the prosecution was not required to grant use immunity to a prosecution witness who invoked his right against self-incrimination at trial, and could instead introduce the witness's preliminary hearing testimony. The defendant argued that this violated his Confrontation Clause rights.
