California Court of Appeal

People v. Martinez, 287255

Held that, on direct appeal of a murder conviction, the defendant may not rely on recently enacted Senate Bill 1437, which changed the law on what mental state is required to be guilty of murder. Instead, he must proceed only by way of a separate petition for retroactive relief.
