Garcia v. Border Transportation Group, LLC, 072521
Held that a driver who worked for a taxi service was not necessarily an independent contractor. Reversed the entry of summary judgment against his claims that were based on Industrial Welfare Commission wage orders; applying the California Supreme Court's recent ruling in Dynamex Operations West, Inc. v. Superior Court, 4 Cal. 5th 903 (2018), which clarified the employee-independent contractor question as to wage order claims.
