California Court of Appeal

People v. Superior Court (Dominguez), 073943

Held that the trial court erred in compelling the People to produce certain materials related to DNA testing in a criminal action. The defendant sought information about a probabilistic genotyping software program called STRmix that prosecutors planned to use at his upcoming murder trial. Granting the People's request for a writ of mandate, the California Fourth Appellate District directed the superior court to vacate its discovery order and conduct further proceedings with respect to the discovery request.
