In re Marriage of Morton, 073689

Held, in a marriage dissolution proceeding, that the trial court should have awarded the wife additional attorney fees, because the record clearly demonstrated a disparity in ability to pay. On what it called a novel question of statutory interpretation, the panel concluded that a trial court must make explicit findings on the ability-to-pay issue.
