California Court of Appeal

People v. Superior Court (Vasquez), 287946

Held that it was unconstitutional to detain a man in state hospitals for over 17 years awaiting trial on a petition to commit him as a sexually violent predator. The man argued that his due process right to a speedy trial had been infringed. Agreeing, the trial court granted his motion to dismiss and ordered that he be released, and the California Second Appellate District refused to disturb that order in a mandamus proceeding.
