People v. Hubbard, 082799

Vacated a sentence imposed on a three-strikes prisoner after he successfully filed a petition for resentencing under Proposition 36. The prisoner contended that the trial court should have considered all aspects of his sentence during his resentencing hearing. Agreeing, the California Third Appellate District remanded to the trial court to resentence him again.
