People v. Carter, 074051
Conditionally reversed the conviction of a man for a murder he committed at age 17. The man claimed that his 55-years-to-life sentence for a crime he committed as a youth was cruel and unusual punishment. On appeal, the California Third Appellate District vacated the sentence and remanded to the trial court, with directions to transfer the case to the juvenile court for a hearing to determine if the case would have been transferred to adult criminal court had the case originally been filed in juvenile court.
