People v. Osotonu, 147060

Remanded for further proceedings on a defendant's request to have his second-degree burglary conviction reclassified as misdemeanor shoplifting. The defendant, who had used explosives to blow open an ATM machine in the middle of the night, appealed from the denial of his petition under California Proposition 47 to resentence him to a misdemeanor on this count. The California First Appellate District agreed with him that the trial court had erred in its Proposition 47 analysis, and remanded for further proceedings.
