Coyne v. De Leo, 149660
Reversed a judgment of possession entered in favor of a landlord in an unlawful-detainer action. The tenant, who did not want to be evicted from the San Francisco rental unit where he had lived for decades, argued that the landlord lacked a bona fide intent to exit the residential rental market, as indicated by a piece of evidence in the tenant's possession. Finding merit in the tenant's argument, the California First Appellate District held that the trial court abused its discretion in excluding the tenant's evidence at trial.
