California Court of Appeal
People v. Bilbrey, 150273
Affirmed that prosecutors violated a defendant's right to a speedy trial. After the defendant petitioned for habeas relief and the trial court ordered a new trial, the prosecutors appealed from the new-trial ruling and did not seek to set a trial date or bring the case to trial. In an amended opinion, the California First Appellate District affirmed dismissal of certain criminal charges because of a violation of the speedy trial right.
