California Court of Appeal

Upheld an arbitrator's decision in favor of a builder in a dispute with a community association over alleged defects in construction. The association, consisting of residential condominium units, argued that its arbitration claim should not have been dismissed on summary judgment even though the association had filed the claim without first receiving the consent of its members, in violation of its declaration of Covenants, Conditions and Restrictions. Agreeing with the builder, the California Fourth Appellate District affirmed denial of the association's motion to vacate the arbitrator's decision.
