California Court of Appeal

People v. Aguayo, 073304

Affirmed the convictions of a defendant who assaulted her elderly father. The defendant argued that the court must vacate one of her convictions (assault by means of force likely to produce great bodily injury) because it was a lesser included offense of the other (assault with a deadly weapon other than a firearm). Rejecting her argument, the California Fourth Appellate District affirmed.
