Cortese v. Sherwood, 152351

Held that the trial court should have dismissed a claim against an attorney for participation in a breach of trust. The attorney, who handled trust and estate matters for a now-deceased wealthy couple and was sued by a daughter for alleged malfeasance, argued that the daughter had failed to comply with California Civil Code section 1714.10, which imposes a prefiling requirement for conspiracy claims against attorneys. Agreeing, the California First Appellate District held that the trial court should have sustained the attorney's demurrer to this cause of action.
