California Court of Appeal

Maplebear, Inc. v. Busick, 151677

Held that an arbitrator's ruling regarding certification of an arbitration class was not immediately reviewable by the superior court. In an employment law case, the employer argued that it should be permitted to obtain immediate review of the arbitrator's ruling that the parties' arbitration agreement permitted the claimant to move to certify an arbitration class. Disagreeing with the employer, the California First Appellate District held that the arbitrator's ruling on this matter was not reviewable at this stage because it was not a final award.
