People v. Lopez, 074581

Affirmed a conviction of petty theft with a prior. The defendant contended that his conviction must be reversed because California Penal Code section 459.5 precludes alternate charging. Rejecting his argument, the California Fifth Appellate District held that the prosecutor was not prohibited from charging the defendant both with shoplifting and petty theft with a prior.
