Reinstated an optometrist's whistleblower lawsuit after her attorneys failed to file an opposition to a motion for summary judgment. The optometrist's new attorneys did not file an opposition to a summary judgment motion after they were substituted into the case following the disqualification of her former attorneys, leading the trial court to find inexcusable neglect and grant summary judgment in favor of the defendants. Reversing, the Fourth Appellate District held that the optometrist was entitled to a continuance to file an opposition to the summary judgment motion.
