California Court of Appeal

Pease v. Zapf, 074405

Held that a San Diego councilmember was not term-limited from running for reelection in the November 2018 general election. A challenger in the primary race contended that the incumbent councilmember was termed out of office because she had served two consecutive terms while living in the same district. Rejecting the argument, the California Fourth Appellate District highlighted that redistricting had occurred between the councilmember's first and second terms, and therefore she had not served two terms from the same district. The panel affirmed the trial court's judgment in favor of the councilmember.
