California Court of Appeal

Hacker v. Homeward Residential, Inc., 278537

Held that a property owner who alleged wrongful foreclosure and related claims should have been granted leave to amend his complaint. The property owner appealed from an order sustaining demurrers and denying leave to amend, arguing that he would be able to sufficiently allege causes of action against the defendant mortgage companies and others. Persuaded by his arguments, the California Second Appellate District reversed and remanded with instructions to grant him leave to amend.
