California Court of Appeal

Winslett v. 1811 27th Avenue, LLC, 146932

Held that the trial court erred in striking a tenant's claims for retaliation, retaliatory eviction, and violation of Oakland's Just Cause for Eviction Ordinance. After the tenant brought this suit to challenge her landlord's actions, the landlord responded by filing an anti-SLAPP motion. On appeal, the California First Appellate District held that the landlord was not entitled to prevail on its anti-SLAPP motion, and thus reversed the trial court's ruling.
