Hall v. Department of Motor Vehicles, 072278

Affirmed that a motorist was not entitled to an award of attorney fees because he did not prevail in his lawsuit against the California Department of Motor Vehicles. After his due process arguments persuaded a court to order the DMV to conduct another license suspension hearing, the motorist argued that he was entitled to recover his attorney fees. Rejecting his contention, the Fourth Appellate District held that he was not sufficiently successful in his lawsuit to qualify for an attorney fee award because all he had obtained was a remand.
