People v. Nuno, 072152
Affirmed a conviction for felony hit-and-run but remanded for resentencing. The defendant, who claimed it was purely accidental when he backed his car into a person with whom he had been having a heated argument, causing a leg fracture, argued that the trial court erred in finding him presumptively ineligible for probation. On appeal, the Fourth Appellate District agreed that the trial court erred with regard to the probation ruling, and therefore remanded for resentencing.
