People v. McKenzie, 073942

Vacated a sentence on drug-related charges and remanded for resentencing. The defendant argued that all of the prior felony drug conviction enhancements must be stricken under new Senate Bill No. 180, which amended Health and Safety Code section 11370.2. On remand from the California Supreme Court, the Fifth Appellate District agreed with him that those sentencing enhancements were invalid.
