Protect Niles v. City of Fremont, 151645

Affirmed that the City of Fremont must assess the environmental impact of a residential and retail development project in a historical district. The city argued that the project would have no significant adverse environmental impact, but a nonprofit organization opposing the project insisted the city must evaluate the impacts on both aesthetics (incompatibility with the historical district) and traffic. On appeal, the First Appellate District agreed with the nonprofit organization and therefore affirmed the lower court's grant of mandamus relief ordering the city to prepare an environmental impact report.
