Doe v. Claremont McKenna College, 281722
Held that a college student who was suspended for one year for having nonconsensual sex was entitled to a writ of administrative mandate setting aside the college's sanctions against him. The student, who insisted the sex was consensual, argued that he did not receive a fair hearing because his accuser did not testify before the college review committee, thus denying the committee an opportunity to question her and assess her credibility. The Second Appellate District agreed with him that the committee's procedures for conducting the hearing were deficient.
