Lacagnina v. Comprehend Systems, Inc. , 147559

Affirmed that a corporate executive who claimed he was fraudulently induced to enter into an employment agreement was not entitled to recover treble damages and attorney fees. Asserting a novel claim, the executive argued that his employer had stolen his labor, and therefore he was entitled to recover treble damages and attorney fees under Penal Code section 496, which makes it a crime to receive stolen property. However, the First Appellate District was not persuaded by his interpretation of section 496, and affirmed the trial court's nonsuit on this particular cause of action.
