California Court of Appeal

People v. Webb, 073592

Affirmed a defendant's conviction of first-degree murder. On appeal, the defendant argued that CALCRIM No. 548 erroneously instructed the jury that it did not need to agree on the theory of murder. Rejecting his argument, the Fourth Appellate District held that any error was harmless beyond a reasonable doubt. The panel remanded solely for a restitution hearing.
