Restore Hetch Hetchy v. City and County of San Francisco, 074107
Affirmed the dismissal of an environmental group's claim that the California Constitution does not allow the O'Shaughnessy Dam to be used to divert water into the Hetch Hetchy Reservoir. The defendants, including the City and County of San Francisco, argued that the environmental group's claim of unlawful water diversion was preempted by the federal Raker Act. The Fifth Appellate District agreed that preemption applied and therefore affirmed the trial court's judgment sustaining a demurrer.
