People v. Phung, 051876

Reversed and remanded the conviction of a defendant who was 17 years old at the time of his gang-related crimes. The defendant argued that changes in California law that went into effect after he was convicted applied retroactively to him, specifically, Proposition 57 and Senate Bill No. 620. On rehearing, the Fourth Appellate District agreed and therefore conditionally reversed the trial court's judgment, ordering the case to be transferred to the juvenile court to conduct a transfer hearing.
