People v. Brayton, 284408
Reversed the denial of a defendant's motion to reduce her felony identity theft conviction to a misdemeanor. In her motion for Proposition 47 relief, the defendant claimed that her conduct in stealing merchandise from a store met the elements of shoplifting and that her felony conviction should therefore be reduced to a misdemeanor. Agreeing, the Second Appellate District reversed and remanded for further proceedings.
