People v. Fleming, 072914

Affirmed a conviction of sexual penetration by artifice, pretense, or concealment. The defendant, who had sexually assaulted his friend's sleeping wife who thought he was her husband, challenged the wording of the pattern jury instruction setting forth the elements of the offense. However, the Fifth Appellate District found no reversible error.
