California Court of Appeal

People v. Bilbrey, 150273

Affirmed an order dismissing a criminal information because of a violation of the right to a speedy trial. After the defendant was convicted of attempted murder and other crimes arising out of an altercation at a bar, the trial court granted his habeas petition and ordered a new trial. While the prosecution's appeal was pending, the defendant contended that his right to a speedy trial was violated. On appeal, the First Appellate District agreed with him and affirmed dismissal of the case.
