Reversed the denial of an immigrant's motion to vacate his conviction of a 2002 drug offense. The immigrant sought relief under California Penal Code section 1473.7, which provides a means for certain noncitizens who pleaded no contest to vacate their convictions based on ineffective assistance of counsel. On appeal, the First Appellate District held that the trial court had erroneously interpreted section 1473.7, and reversed and remanded.
