Reversed the denial of an amended petition and remanded in a case where the issue was whether a criminal defendant's 1980 felony grand theft conviction could be redesignated as a misdemeanor. The defendant petitioned for redesignation under Proposition 47, which reduced the punishment for certain theft- and drug-related offenses. In reversing, the Sixth Appellate District found that the trial court was unaware of its discretion to accept an amended petition.
