California Court of Appeal

People v. Murdock, 279452

Held that a defendant was denied due process because of the delay in resolving a charge that he had absconded while on postrelease community supervision (PRCS). The defendant maintained that his due process rights were violated because the PRCS revocation matter was not resolved within a reasonable time after he made a demand to be brought to trial and/or sentenced. In reversing the district court, the Second Appellate District agreed with him about the due process violation and also concluded that he suffered prejudice as a result of it.
