Y.H. v. M.H. , 071859

Affirmed that a child support obligor was entitled to a credit for certain payments in a case where a father applied for Social Security Disability Insurance for himself and his daughter and was eventually approved six years later, after which the Social Security Administration sent a large lump sum payment to his former wife as custodial parent of their daughter. The father sought a credit for payments he made during the 6 year period. On a question of first impression in California, the Fourth Appellate District agreed that he was entitled to a credit for the SSDI payment, given that he was not in arrears on his child support obligation.
