Reversed a conviction for the sale of marijuana in a case where the defendant operated a business selling medical marijuana products in Livermore, which has a municipal ordinance prohibiting marijuana dispensaries. The defendant contended that the trial court erred by denying him the ability to assert a medical-marijuana defense. The appeals court agreed and overturned his conviction, holding that the trial judge's ruling that barred him from raising a medical-marijuana defense violated his constitutional right to present a defense.
