People v. Hurlic , 286082

Reversed and remanded. A California law that went into effect in 2018 known as Senate Bill No. 620 grants a trial court the discretion to waive certain firearm sentencing enhancements that were previously mandatory. Under the new law, which is retroactive, a criminal defendant who had earlier pleaded no contest to attempted murder and accepted a 20-year mandatory sentencing enhancement for the personal discharge of a firearm was not required to obtain a certificate of probable cause from the trial court to challenge the sentence enhancement on appeal, the Second Appellate District concluded.
