In re Sofia M, 055752

Affirmed post judgment order. In a child abuse case, children were removed from their Mother and placed with relatives. The Mother appealed the decision to terminate her parental rights as to the oldest child Sofia, then 14. The Mother alleged that she was being prevented from seeing her daughter. However, it was the daughter, Sofia, who refused to see her Mother. The appellate court held that it is not a court duty to force a child to visit the Mother. The court can make reasonable efforts and attempt to persuade, but cannot force.
