California Court of Appeal
In re D.A., 283932
Affirmed. Defendant argued that her conviction for misdemeanor battery was improper because there was insufficient evidence to establish the corpus delicti of the crime. She argued that the boyfriend she allegedly hit did not testify at trial and the only evidence was her words at the crime scene. The appellate court disagreed with her and affirmed her conviction. Corpus delicti must be established independently from defendants statements, but independent proof is slight can be inferred.
