In this sexual assault against a minor action, the Fifth Appellate District affirmed the judgment of the trial court. The Appellate court rejected defendant’s claims as to insufficient evidence and ineffective assistance of counsel and concluded defendant was not prejudiced by erroneous jury instruction. In the unpublished portion of the decision, the court agreed that the abstract of judgment should be corrected, but otherwise rejected defendant’s contentions, but did remand to the trial court to exercise its discretion as to whether to strike the firearm enhancement.
