Skidgel v. Cal. Unemployment Ins. Appeals Bd. , 151224
The First Appellate District court upheld the decision of the California Unemployment Insurance Appeals Board (CUIAB) to deny unemployment compensation to in-home service providers paid for by In-Home Supportive Services (IHSS) to provide services to elderly or disabled persons. The CUIAB had ruled in the Matter of Caldera (2105) P-B-507 that the elderly or disabled person was the recipient of monies provided by IHSS and the service providers, typically close family members were the employees of the recipient and therefore not entitled to unemployment compensation. The Appellate court agreed with the reasoning of Caldera.
