California Court of Appeal

National Biweekly Administration, Inc. v. The Superior Court of Alameda County, 150264

Granting a petitioner's request for extraordinary relief, in part, concluding that the gravamen of the statutory causes of action asserted against a debt payment service that promises to reduce interest owed by accelerating debt repayment with an extra annual payment sued under the Business and Professions Code giving them a right to the jury trial a court denied them, but also concluding that the right to a jury trial only extends to the issue of liability and the amount of statutory penalties as well as any appropriate equitable relief.
