California Court of Appeal

P. v. McVey, 280966

Affirming the judgment of conviction of a man for voluntary manslaughter because the trial court did not err in excluding evidence the victim had been diagnosed with paranoid schizophrenia and behaved aggressively in two confrontations with police 20 years earlier and declining to remand to reconsider the firearm enhancement the court had explicitly said it would not reduce under the Penal Code in the case of a shooting after a man was sold powdered sugar in lieu of cocaine and, still enraged, shot a homeless man.
